Annexe 2 - Conditions Consistent with the Operating Schedule
General
1. An Event Manager will be on-site to monitor and ensure all licensing objectives are met.
2.The Licensee will have valid public liability insurance in force and a copy of the schedule will be available for inspection by an authorised officer on request.
3. In addition to the hours stated, alcohol and regulated entertainment may continue in the barn until 01:00 on Fridays and Saturdays on a maximum of 10 occasions in a year, no more than 2 per calendar month, and only on dates that have been notified to the Council by 31 January each year; with any additions and cancellations notified no later than 14 days prior to the event.
4. On a maximum of twelve occasions from Sunday to Thursday live music, recorded music and the supply of alcohol may continue until mid-night, no more than two per calendar month and not on consecutive nights. Notification of dates on which this provision will be utilised shall be given to Council no later than 31 January each calendar year with additions and cancellations to be notified no later than 14 days prior to the event.
5. For as long as the planning condition No 16 of C12/0391 dated 24 May 2012 or any modification of it is in force, these events must coincide with occasions when that condition is invoked.
6. Notification to the local planning authority will also suffice as notice to the licensing authority.
7. If there are more than 250 guests attending on any of these occasions the licensable activities must stop at 00.30.
8. On all of these occasions the barn must be closed to the public by 01.30 am.
The Prevention of Crime and Disorder
1. An event manager will be on site at all times whilst an event is running.
2. Where glass bottles are used, they will be retained or disposed of on the premises.
3. The Licensee will ensure that customers are not permitted to take opened bottles or glasses out onto the public highway, during times, for example, when they are complying with the provisions of the smoke free regulations or making use of any pavement café permission held by the licensed premises.
4. The Licensee will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule
5. The Licensee will ensure that the maximum occupancy of the licensed premises is restricted at any one time to 400 inside The Barn.
6. The Licensee will ensure that any person selling or supplying alcoholic drink under the authority of a personal licence holder asks for a photo ID proof of age where they have reason to suspect that the individual may be under 18 years of age.
7. The Licensee will not permit any irresponsible drinks promotions at the licensed premises which may negatively impact on the promotion of the licensing objectives.
8. The Licensee will ensure that public information notices about crime and disorder issues are displayed at the request of the Council or the Suffolk Constabulary.
9. The Licensee will participate in the local pubwatch/nightsafe scheme operating in the District.
Public Safety
1. An event manager will be on site to ensure health and safety/ fire safety requirements are adhered to. Fire fighting equipment will be inspected annually to ensure they are serviceable.
2. The Licensee will ensure that lighting is provided outside the premises (and in the private car park) during the hours of darkness when any licensable activity takes place on the premises.
3. The Licensee will make free drinking water available at all times the premises is open to the public
4. The Licensee will provide a chill-out area which is cooler and quieter than the dancing areas
5. Access for emergency vehicles will be kept clear and free from obstruction
6. The Licensee will make sure that adequate and appropriate supply of first aid equipment and materials are available on the premises
The Prevention of Public Nuisance
1. A noise limiter is fitted and will be maintained.
2. An event manager will be present during all events to monitor and react as required.
3. The event manager will patrol the outside of the building during an event to ensure noise/music levels are at a reasonable level to ensure neighbours are not disturbed.
4. The Licensee will be responsible for the disposal of waste on the frontage of the premises and make provision for the emptying of litter bins in the vicinity of the premises
5. The Licensee will make sure that noise or vibration is not noticeable at the façade of any noise sensitive premises and/or residential properties including periodic monitoring;
6. The Licensee will install and use a noise limiter(s) on amplification equipment following consultation with the Council’s Environmental Health Officers;
7. The Licensee will make sure that the placing of bottles into receptacles outside the premises takes place at times that will minimise disturbance to nearby properties;
8. The Licensee will ensure that offensive smells from the licensed premises are not permitted so as to cause a nuisance to nearby properties and the premises are properly vented.
9. The Licensee will ensure that receptacles for waste are emptied regularly to minimise nuisance smells.
10. External lighting shall be installed and maintained at the licensed premises in order to promote the licensing objectives and the Licensee will liaise with the appropriate Environmental Services department to ensure that any lighting is positioned and of such design so as to minimise the risk of causing public nuisance by light pollution.
11. The Licensee will provide adequate and suitable (lidded) receptacles to receive and store refuse from the premises/site
12. The Licensee will make sure that receptacles for refuse storage are maintained in a clean condition.
13. The Licensee will make sure litter is regularly cleared from the vicinity of the premises
14. The Licensee will provide for the removal, within 24 hours of the finish of the event, of:
All refuse (including litter picking across the site).
Off site litter within one mile of the site along access and egress routes to the event in respect of outdoor events only.
15. The volume of any description of regulated entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of residential properties.
16. A responsible person shall monitor the noise levels at the boundaries of residential properties, and implement any changes to reduce the noise levels in accordance with any request by an authorised officer of the council immediately and ensure that the volume is maintained at a reduced level.
17. A noise limiting device shall be operational within Bruisyard Hall Barn at all times when amplified regulated entertainment is taking place. This shall operate in accordance with the criteria set by the Environmental Protection Team and any changes to the noise limiting device shall be agreed with the Environmental Protection Team prior to their implementation.
18. All external doors and windows to the Barn must be kept closed after 22.00 other than for access and egress when any regulated entertainment is taking place within the Barn EXCEPT on no more than 5 occasions per year when a marquee is attached to the Barn (not for the provision of licensable activities but rather to provide additional seating at an event where catering is provided) the external door of the barn leading into the marquee may remain open until 23.00.
19. The licensee shall ensure that adequate steps are in place (e.g. signage, sufficient staff on site) to ensure that customers leave the premises quietly.
The Protection of Children from Harm
1. An event manager will be present during all events to monitor and react accordingly.
2. Children will be supervised by a responsible adult at all events.
3. The Licensee will comply with Retailer Alert Bulletins issued by Portman Group
4. A crime prevention policy agreed by the police and local authority will be in place;
5. The Licensee will implement a proof of age policy agreed by the police and local authority.
6. The Licensee will ensure an adequate risk assessment is in place with regard to the protection of children from harm whilst they may be present on the premises and while licensable activities are taking place. Such risk assessment to be produced to an authorised officer on demand.
7. The Licensee will require that children under the age of 12 are accompanied by adults after 11pm in the evening.
