Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
Crime and Disorder
1. Challenge 21' scheme shall be implemented, with prominent signage displayed throughout and staff will be trained to implement this.
2. The DPS will maintain an incident book on the premises at all times. Any incident/injury/ejection/refusal/drug misuse/seizure/age challenge will be detailed. Details will include times/dates and be signed and produced for the Police/authorised Licensing Officers on demand.
3. The DPS shall implement an ejection policy ensuring all instances of drunkenness, disorder, drug use or violence are challenged, resulting in the ejection or retention of the individual(s) and under serious circumstances, consideration shall be given to their permanent exclusion from the premises in the future. All such instances will be notified to the police at the time of happening or as soon as possible thereafter using the appropriate method, emergency or non-emergency contact dependent on the circumstances.
4. Where an offence of violence has been committed we shall take all reasonable steps to identify the offender and pass the identity to the Police as soon as reasonably practicable. An incident book entry will be made on all occasions; timed, dated and signed.
5. Staff will be trained in the sale of alcohol and training records kept in-house and available for Police and authorised Local Authority Officers on demand. Training will be on-going and reviewed.
6. The DPS will ensure no persons under the age of 18 years will be permitted on the premises unless accompanied by a suitable adult/parent or guardian.
7. Work in partnership with local police and local authorities (eg, Crime & Disorder Reduction Partnerships).
8. Refuse entry to know criminals and 'trouble-makers'. Refuse sales of service and alcohol to people who are drunk.
9. Responsible alcohol retailing and promotions will be implemented.
10. There will be a zero drugs tolerance policy implemented.
11. Effective DPS and staff training will be provided.
12. Provide good service, empathy and be polite.
13. Provide local taxi number to avoid drink driving.
14. Provide a good range of non-alcoholic drinks.
Public Safety
1. Fire exists are clearly identified and clear of obstruction. A fire alarm system will be in place. There will be a comprehensive fire evacuation policy and fire fighting equipment and fire safety & evacuation training. Fire risk assessment completed and reviewed.
2. A reporting system of suspect packages and employee training will be implemented.
3. First Aid equipment - fit for purpose - will be available. An accident reporting policy/book will be implemented.
4. Glasses and bottles will regularly be cleared away.
5. Electrical sockets will not be overloaded. Electrical equipment will be maintained. There will be regular maintenance on gas and electrical appliances.
6. Health and hygiene practises shall be strictly followed. Food hygiene training will be implemented. Regular cleaning schedules and pest control will be regularly enforced.
7. All chemicals will be safely stored and COSHH procedures will be implemented.
8. Health & Safety policy and risk assessments will be documented. There will induction and refresher training for all the staff.
9. Guidance and advice will be sought from the Police, Fire Service, Health & Safety, Local Authority and Environmental Health Officers.
Prevention of Public Nuisance
1. Acoustic levels of background music and TVs will be limited. Close windows and doors.
2. Noise from refuse and disposal collections will be controlled; particularly disposal of glass & bottles.
3. Smoking areas will be dictated.
4. Bottles and glasses will not be allowed to be removed from the premises.
5. Kitchen extractor filters will be cleaned regularly. A regular waste collection will be arranged. Waste will be stored in suitable covered containers.
6. Lights will be directed away from neighbours.
7. Pest control contactors will be employed and excellent levels of food hygiene and cleanliness will be maintained.
8. The outside of the premises will be cleared regularly.
9. Relations with Environmental Health Officers and the Local Authority will be maintained.
Protection of children from harm
1. There will be high profile signage of the ‘Challenge 21’ policy towards young people both on entry and at the point of sale.
2. An underage sales policy will be adopted and enforced.
3. Acceptable forms of ID will be restricted to Passports, photo Driving Licence or Proof of Age Card with PASS hologram.
4. Alcohol will be kept out of reach behind the bar.
5. The consumption of alcohol by adults accompanied by children will be controlled.
6. A refusals book will be kept.
7. Front line staff will be trained in all age restriction.
