Additional Conditions

• Annex 1 - Mandatory Conditions

   

  1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2.  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3.  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  4. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5.  The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

   

  (b) customers are made aware of the availability of these measures.

• Annex 2 - Conditions Consistent with the Operating Schedule

   

  General Conditions

   

  1.  The premises will be managed in accordance with Club rules.

   

   

  2. Conditions imposed by The Licensing Act 1964.

   

        Alcohol shall not be sold or supplied except during permitted hours.

   

        In this condition, permitted hours means:

  )          On weekdays, other than Christmas Day, Good Friday or New Year’s Eve,

                   10 a.m. to 11 p.m.

  )          On Sundays, other than Christmas Day or New Year’s Eve,

                   12 noon to 10.30 p.m.

  )          On Good Friday, 12 noon to 10.30 p.m.

  )          On New Year’s Eve, except on a Sunday, 10 a.m. to 11 p.m.

  )          On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.

  )          On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:

                i)              not exceed six and a half hours;

                ii)               not begin earlier than 12 noon;

                iii)               not end later than 10.30 p.m.

                iv)               provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;

                v)               not extend for more than three and a half hours after 5 p.m.

                g)              On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).

   

   

  3.               The above restrictions do not prohibit:

  )           during the first twenty minutes after the above hours, the consumption of the               alcohol on the premises;

  )           during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;

  )           during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;

  )           the supply to, or consumption by, any person of alcohol in any premises where they are residing.

   

   

  NB:              A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.

   

  The Prevention of Crime and Disorder

  1         There will be no irresponsible drinks promotions.

  2         All members of staff at the premises will seek PASS accredited proof of age cards, photo-driving licences or passports as proof of age evidence from any person who appears to be under the age of 18 and who is seeking to purchase or consume alcohol on the premises.

   

  Public Safety

  3         Emergency exists will be properly maintained and adequately illuminated.

  4         Smoke detectors will be properly maintained.

  5         Fire extinguishers will be properly fixed and maintained.

  6         Notices will be displayed regarding the procedure to be followed in the event of an emergency and emergency procedures will be practised on a regular basis.

  7         Testing of emergency procedure will be recorded in a log book.

  8         An adequate first aid kit will be provided and maintained at the premises.

  7.    Access for emergency vehicles will be kept free of obstruction.

   

  Public Nuisance

  9         The use of the outside areas including the beer garden and external seating shall not be permitted after 23.30 hours

  10     The volume of the amplification system shall be strictly controlled so that noise levels are non-intrusive at nearby residential properties.

  11     During any music event, a responsible person shall monitor the music levels outside the building and immediately implement any changes necessary;

         To ensure noise levels remain non-intrusive at nearby residential properties

         in accordance with any request by an authorised officer of the Council.

                Any such changes in noise levels shall be maintained at the reduced level for the period of the music event.

  4.              No outdoor music shall be played after 21:00 hours, in the evening.

  5.              All outdoor music events shall be notified in writing to the Environmental Protection Section at Suffolk Coastal District Council at least 14 days prior to the event.

  6.              The windows to the function room used for the playing of music shall be kept closed when musical entertainment (other than background music) is taking place.

  7.              The external doors to any function room used for the playing of music shall be kept firmly closed when musical entertainment (other than background music) is taking               place.

  8.              In the event that additional ventilation is necessary to the function room, a detailed scheme shall be submitted to the Environmental Protection Section and only an               approved scheme shall be fitted.

  9.              The Food and Safety Team must be notified in writing 8 weeks prior to any event where it is likely that more than 500 persons will be on the licensed premises at any               one time.

  10.              Adequate litter bins will be provided, both inside and outside the premises.

  11.   Notices will be displayed asking those leaving the premises to respect local residents

   

  Protection of Children from Harm

  1          Children will be adequately supervised by a responsible adult.

  2          A fire guard will be in place a properly secured when children are present.
