  Annex 1 - Mandatory Conditions

   

   

  SUPPLY OF ALCOHOL

   

  Where a premises licence authorises the sale of alcohol, the licence must include the following conditions:

   

  1. (1)No supply of alcohol may be made under the premises licence -

   

           At any time when there is no designated premises supervisor in respect of the premises, or

           At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)               Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  2. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  3.  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  4.  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  5. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  6.  The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

   

  (b) customers are made aware of the availability of these measures.

   

  EXHIBITION OF FILMS

   

  1)      Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section -

   

  2)      Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3)      Where -

   

  )          the film classification body is not specified in the licence, or

  )          the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4)              In this section -

   

  “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

  Annex 2 - Conditions Consistent with the Operating Schedule

   

  General

   

  Noise Management Strategy Plan

   

  A Noise Management Strategy Plan shall be provided to the satisfaction of Suffolk Coastal District Council Environmental Protection Team at least 60 days prior to the event. This strategy shall identify how noise arising from the event will be effectively controlled so as to prevent public nuisance and show full compliance with licence conditions and with the Code of Practice on Environmental Noise Control at concerts (published by the Noise Control Council ISBN 2900103515).

   

  In particular the strategy plan shall include the following;

   

  1.              A plan of the site indicating the main stages and where noise will arise

   

  2.   Full details of the regulated entertainment

   

  3.   Details of the Acoustic Consultancy or Noise Management Service to be used

   

  4.              Measures to be taken prior to the event in respect of noise mitigation, (i.e. agreement of noise monitoring points, noise propagation analysis, background noise survey, resident letter drop)

   

  5.              Liaison with Suffolk Coastal District Council Environmental Protection Team

   

  6.              Noise Risk Assessment for staff and members of the public who may be exposed to hearing damage, including target sound levels at front of house

   

  7.              Other noise emissions at the event, (i.e. fireworks, pyrotechnics, funfairs etc)

   

  8.   Control of unauthorised noise on site (i.e. private parties)

   

  9.   Over run strategy

   

  Water Safety Plan

   

  A Water Safety Plan shall be provided to the satisfaction of Suffolk Coastal District Council Environmental Protection Team at least 60 days prior to the event. The water safety plan is the operating manual for the entire water supply to ensure it is sufficient, fit for purpose, constructed and maintained in a manner so as to comply with the private water supplies regulations. It will help you to create and maintain a safe and effective supply and will show us that you are doing so and how.

   

  In particular the water safety plan shall include the following;

   

  1.              Details of the water main to be used for the event, its construction, age and size

  2.              Details of how and where you intend to connect to the water main

  3.              Full details of the water supply infrastructure you intend to install including methods of disinfection, back flow protection, pipe construction and materials, isolation valves, storage, pressure boosters, types of water points (all of which must be WRAS approved)

  4.              Details of all other water points connected to the main (for example estate properties and items such as animal troughs and estate standpipes) and measures to prevent back siphoning into the system

  5.              A full plan showing all water points, position and construction of supply pipes, disinfection units, storage and any other equipment associated with the provision of water to the festival

  6.              Methods to ensure there is effective disinfection of the water, how this will be achieved, monitored and maintained.

  7.              Sampling regime (parameters being sampled for and what frequency)

  8.              Details of those responsible for the water supply including the plumbers (who should be appropriately qualified and preferably hold a blue card) and the over all manager

  9.              Details of installation procedures and how these seek to prevent contamination of the water supply

  10.              Details of how the water supply will be commissioned ready for use after installation

  11.              Details of how the water supply will be checked before, during and after the event and for what parameters

  12.              Details of the cleaning regime

  13.              Details of infrastructure security so as to prevent or rectify problems (such as damage, vandalism and illegal connections)

  14.              Details of contingency plans should the water supply fail (alternative supplies etc)

  15.              Details of any waste infrastructure (drains and sewers) or details of collection and transfer points if tankering of waste is intended on site (details to be included on the site plan requested above)

  16.              A risk assessment of the water supply to identify areas that require addressing.

   

  The prevention of crime and disorder

   

  1.              FolkEast Productions undertakes to employ sufficient numbers of SIA accredited security staff who will operate a bag/ body search at the main entrance to the arena in compliance with our "Search Policy"

   

  2.              A full time SIA registered person will be posted at all public alcohol outlets.

   

  3.              We will run a proof of age policy for under 21's.

   

  4.              An incident book will be kept.

   

  5.              All confiscated items will be locked in a secure container.

   

  6.              Any incident considered to be relevant to the police will be reported.

   

  7.              The premises licence holder/DPS will ensure the event is run in accordance with the event management plan

   

  8.              The licence holder/DPS will ensure that the Event Management Plan will clearly describe in detail to the processes to be followed in the event of lost children and their welfare. The intention of the policy shall be to reunite each lost child with its parents or guardians. A comprehensive register of all contact with children or vulnerable persons will be completed to include observations relating to any evidence or suspicion of abuse or neglect. This register will be made available to the Licensing Authority or any other Responsible Authority on demand.

   

  9.              The Premises Licence Holder/DPS or a nominated deputy must be on the licensed premises and available to the Responsible Authorities and the Licensing Authority at all times when licensable activities are taking place.

   

  10. The Premises Licence Holder/DPS shall ensure that all personnel within the management structure of the event including contractors and sub-contractors involved in the organisation of the event shall be aware of the conditions applied to this Premises

   

  11.The premises licence holder/DPS will ensure that at least one personal licence holder shall be located at all times within an area open to the public for the sale and supply of alcohol, or at each bar area.

   

  12. The Licence holder/DPS shall make sure that staff on the premises monitor and record the number of patrons within the premises

   

  13. The Premises Licence Holder, DPS or nominated person shall report to the police all instances of Crime and Disorder.

   

  14. The Premises Licence Holder, DPS shall at each public bar, have in place at least one SIA door staff member. They will be located as a default at each licensed bar area during licensable hours. They will have the capacity to deploy to any incidents at other locations where required, but must return to their default position afterwards.

   

  15. The Premises Licence Holder, DPS or person nominated by them for the purpose, shall provide a register of SIA registered staff to be engaged at any time during the Festival, at least 14 days prior to the Festival commencing. A reserve list of Security staff will be produced, showing SIA licensed persons who will be called upon to replace any SIA who are for any reason unavailable to work in their previously identified duty This register shall record SIA staff names, dates of birth, and addresses along with their badge numbers. The register will be maintained during the Festival to ensure an accurate account of those SIA staff present. The register shall be made available on demand for inspection by the Police, Licensing Authority or an authorised officer of the Security Industries Authority.

   

  16. The licence holder/DPS will ensure that a search policy shall be implemented. A minimum ratio of one in ten customers will be randomly searched upon entry to the licensed premises. ALL persons suspected of possessing prohibited articles will be searched upon entry. Clear signage will be prominently displayed advising the public that they may be searched as a condition of entry. Female customers will only be personally searched by a female member of SIA staff. A secure facility will be made available into which any prohibited articles are deposited prior to be taken to the main security centre for recording. No customer will be granted admittance with any glass bottle or container.

   

  17. The licence holder/DPS will ensure that no person under the age of 18 years will be employed as Stewarding personnel.

   

  18. The licence holder/DPS will ensure that no Security staff or Stewards are to consume or be under the influence of alcohol or drugs whilst working.

   

  19. The licence holder/DPS will ensure that any plain-clothes security personnel shall carry an identity badge issued by the Event Organisers confirming that they are security personnel, which shall be produced to a member of the Licensing Authority or Police on demand.

   

  20. The Premises Licence Holder/DPS shall employ an internal radio system allowing two-way communication between all members of relevant staff and representatives of relevant Responsible Authorities.

   

  21. The licence holder/DPS will ensure that an incident log must be kept at the premises, and made immediately available on request to an authorised officer of the Licensing Authority or other Responsible Authority, which, as a minimum, must record the following:

   

  i.                All crimes reported to the venue,

  ii.              All ejections of patrons,

  iii.              Any complaints received,

  iv.              Any incidents of disorder,

  v.              Any reported accident or injury,

  vi.              Seizures of drugs or offensive weapon

   

  22. Such matters shall be timed, dated and signed by the author and produced to Police/Authorised Licensing Officers on demand.

   

  23. The licence holder/DPS will ensure that an ejection policy will be robustly implemented.

   

  24. All instances of drunkenness will be challenged, with consideration given to the ejection or retention of the individual(s). Any person involved in Violence or Disorder or found in possession of Illegal Drugs, weapons or articles that may be used in the commission of crime, will be brought to the immediate attention of the Police and will be excluded from the Festival.

   

  25. All instances of ejection of persons from the premises must be notified to the Police at the time of happening or as soon as possible thereafter. Where an offence of violence has been committed the SIA and Stewarding staff shall retain the offender for hand over to the Police or will take all reasonable steps to identify the offender and pass the identity to the Police as soon as is reasonably practicable. An incident book entry shall be made on all occasions; timed, dated and signed by a member of staff.

   

  26. The Licence holder/DPS shall ensure that drinks are only available for consumption from plastic or polycarbonate vessels. All glass bottles will be decanted into such containers.

   

  27. The Licence holder shall ensure that no drinks are available for consumption from glass bottles.

   

  28. The licence holder/DPS will ensure that no customers will be admitted, or permitted to leave when carrying open or sealed bottles or glasses.

   

  29. The licence holder/DPS  will ensure that all staff engaged in the sale of alcohol will be 18 years or over and, if not Personal Licence Holders, shall be trained in Responsible Alcohol Retailing to the minimum standard of BIIAB level 1 or equivalent. Their training records shall be kept on the premises and produced to the Police and authorised Local Authority Licensing Officers on demand. For the avoidance of doubt this training can be administered in-house in accordance with the relevant criteria, which as a minimum will cover:

   

  i.              The nature of alcohol and the effect that it has on the human body.

  ii.              The main issues in the 2003 Licensing Act as they relate to alcohol retailers and servers,

  iii.              Licensing law in relation to the Protection of Children from Harm, including an awareness of proxy sales,

  iv.              The social responsibilities relating to the retail sale of alcohol,

  v.              How to recognise drunkenness, and your duty not to serve drunk customers,

  vi.              Appropriate strategies that can be adopted to prevent or eliminate alcohol-related crime and conflict and the importance of personal safety.

   

  30. The licence holder/DPS will ensure that to enhance the mandatory condition for an age verification policy, the premises shall operate a ‘Challenge 21’ scheme. The details of the scheme shall be written down in the Event Management Plan under the ‘Sale of Alcohol’ Chapter, a copy of which shall be located at each area used for the sale and supply of alcohol. The policy shall be produced on to authorised officers of the Licensing Authority or Police on demand. Prominent, clear and legible signage shall be displayed at all entrances to the premises as well as at, a minimum of once every five metres behind any bar advertising the scheme operated.

   

  31. The licence holder/DPS will ensure that the premises shall only accept a valid in-date form of identification for the purposes of authorising the sale or supply of alcohol.

   

  32. The licence holder/DPS will ensure that a register of refusals will be kept at each bar and other area where the sale and supply of alcohol takes place. The register will detail the date and time of refusal, the names or descriptions of those people who have been refused the service of alcohol and the name and signature of the person making the refusal. The DPS or nominated person will collate these records on a daily basis and make the information available to authorised officers of the Licensing Authority and Police on demand.

   

  33. The licence holder/DPS will ensure that Prominent, clear and legible signage shall be displayed stating that: It is an offence to purchase or attempt to purchase alcohol if you are under the age of 18 - Section 149 Licensing Act 2003.

   

  34. The licence holder/DPS will ensure that a visible selection of soft drinks will be available to purchase from all areas involved in the sale and supply of alcohol, along with an ample supply of free drinking water at clearly signed locations throughout the Licensed Premises. Drinking water shall also be available at all bars with signage relating to its availability being clearly displayed in the bar area.

   

  Public safety

   

  1.              A suitable and sufficient risk assessment combined with effective and responsible site management and provision of a sufficient number of qualified staff will enable us at all times to be in control of public safety.

   

  2.              All temporary structures will have current sign off certificates and a full water safety plan will be in place.

   

  3.              Wind speeds will be monitored throughout the weekend and appropriate measures will be taken in the event of wind speeds approaching max permitted levels.

   

  4.              All food outlets will be registered with a local authority.

   

  5.              The event will be run in accordance with the safety provisions contained within the event management plan

  6.              The event management plan will detail how the event will be managed

  7.              The event management plan will contain the significant findings of the risk assessments carried out for the event

  8.              The event management plan will be sent to the Food and Safety Team at Suffolk Coastal District Council at least 28 before the event

  9.   Any changes to the event management plan that are made within 28 days of the event must be brought to the attention of the Food and Safety Team at Suffolk Coastal District Council

   

  The prevention of public nuisance

  General principles

   

  1         All systems of sound amplification and reproduction through the public address system shall remain under the control of the Licensee. Such control may be via a Licensing Compliance Officer or appointed Acoustic Consultant. The only exception to this is where an authorised officer of the Licensing Authority or the emergency services, in accordance with the Emergency Contingency Plan, has assumed the control of the system.

   

  2         Sound Control Engineers with authority to alter music amplification levels shall be nominated by the Licensee and confirmed in writing to the Licensing Authority at least 7 days before the start of the event. The Licensee and any appointed Sound Control Engineers shall comply with all reasonable requests made by an Authorised Officer of Suffolk Coastal District Council Environmental Protection Team to reduce the Music Noise Level in order to prevent public nuisance. Compliance with any such instruction shall be implemented as soon as possible and, in any event, within fifteen minutes of the instruction being given.

   

  3         All sound amplification systems under the control of the Licensee shall not be used outside of the permitted hours for regulated entertainment, except for emergency announcements relating to public order and safety. 

   

  4         Noise from other sources on site that are under the control of the Licensee but which do not fall within the description of regulated entertainment (e.g. mobile generators and litter and waste removal activities) shall not be audible within any of the nominated noise sensitive properties between the hours of 23:00 and 08:00.

   

  5         No pyrotechnics display shall be permitted unless the content and timing of such a display has been agreed in writing with the Licensing Authority at least 14 days prior to the event.

   

  6         The Licensee shall make all reasonable endeavours to ensure that no noise nuisance is caused by non licensed sound amplification systems during the event.

   

  Prior to the Event

   

  7         At least three weeks prior to the start of the event the Licensee shall advertise a Noise Complaint Hotline telephone number that will be available for the duration of the event. The adverts shall be in the form of a mail drop to all properties within a 3 Km radius of the site.

   

  8         All operations involved in the erection of the stages and all other temporary structures on the premises licence application site shall only take place between the hours of 08:00 and 23:00.

   

  9         The installation of the sound amplification systems shall be completed no later than 18.00 on Thursday 22 August 2013 (and the equivalent day and time in future years) in order to allow for sound testing and any necessary adjustments.

   

  10     A noise propagation test shall be undertaken prior to the start of the event in order to set appropriate control limits at the sound mixer positions.  The sound systems for the event shall be configured and operated in a similar manner as intended for the event.  The sound source used for each test shall be similar in character to the music likely to be produced during the event.  The sound tests shall be undertaken in the presence of an Authorised Officer from Suffolk Coastal District Council Environmental Protection Team and the noise limits set shall be used for the duration of the festival.

  Noise Control at the Event

   

  11     Rehearsals and any additional essential sound checks shall only be permitted during the hours permitted for the performance of regulated entertainment. No musical entertainment shall be permitted outside of these hours.

   

  12     Between the hours of 11:30 and 23:00 on Friday 23, Saturday 24 and Sunday 25 August 2013, (and the equivalent days and times in future years) the Music Noise Levels (MNL) when measured at any of the nominated noise sensitive properties shall not exceed 65 dB LAeq (15 minute).

   

  13     Between the hours of 18:00 and 00:00 on Thursday 22 August 2013, and 23:00 hours and 00:00 on Friday 23, Saturday 24 and Sunday 25 August 2013, (and the equivalent days and times in future years) music entertainment shall be 'low key' and shall not be audible within any of the nominated noise-sensitive premises. Hence, the Music Noise Levels (MNL) when measured outside any of the nominated noise sensitive properties shall not exceed the following levels;

           40 dBA LAeq (5 minute) or the Background Noise Level LA90 (5 minute) by more than 15 dB LAeq (5 minute) 

           55 dB Leq (5 minute) in any 1/3 octave band between 50 Hz & 160 Hz or the Background Noise Level LA90 (5 minute) in any 1/3 octave band between 50 Hz & 160 Hz by more than 15 dB LAeq (5 minute).

   

  14.  There shall be no regulated entertainment after 00.00 and before 11:30 hours on any day of the event.

   

  15. The nominated noise sensitive properties where the agreed Music Noise Levels are to be measured are to be agreed in writing with an Authorised Officer from Suffolk Coastal District Council Environmental Protection Team and inserted within the Noise Management Strategy Plan.

  After the Event

   

  16     All operations involved in the dismantling of the stages and all other temporary structures on the premises licence application site shall only take place between the hours of 08:00 and 23:00.

   

  Note

  The Music Noise Level's are based on the ‘Code of Practice for Environmental Noise at Concerts’ 1995 produced by the Noise Council. This is a widely used standard used throughout the U.K.

   

  17A full and effective noise propagation survey will be in place and continuous noise level monitoring will be carried out.

   

  18. A full traffic management plan will be in place to minimise disruption to the local area.

   

  19. All properties in the area that are considered to be "at risk" will be contacted by letter in advance and offered reduced price tickets.

   

  20.We will publish a phone number that local residents can contact us direct on.

   

  The protection of children from harm

   

  1. All youth tickets up to and including 17 have to be purchased in conjunction with an adult ticket, there will be a youth wristband to identify them which in conjunction with the proof of age policy operated by the alcohol outlets will control under age drinking.

   

  2. All children's areas will be supervised by appropriate adults with full CRB checks in place.

   

  3. A full lost children plan will be part of the event operation manual.

   

  4. There will be a sufficient mix of male/female SIA staff who will in conjunction with the event safety officer will take control of any incident that occurs.

• Annex 3 - Conditions attached after a hearing by the licensing authority
