Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
1 The premises will be managed in accordance with the rules of the Club.
2 Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
On weekdays, other than Christmas Day, Good Friday or New Year’s Eve,
10 a.m. to 11 p.m.
On Sundays, other than Christmas Day or New Year’s Eve, 12 noon to 10.30 p.m.
On Good Friday, 12 noon to 10.30 p.m.
On New Year’s Eve, except on a Sunday, 10 a.m. to 11 p.m.
On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.
On Christmas day, as provided by the rules of the club and notified in writing by the
chairman or secretary of the club to the chief executive of the justices for the petty sessions
area I n which the premises are. The said hours shall:
i) not exceed six and a half hours;
ii) not begin earlier than 12 noon;
iii) not end later than 10.30 p.m.
iv) provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v) not extend for more than three and a half hours after 5 p.m.
g) On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).
NB: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
The above restrictions do not prohibit: during the first twenty minutes after the above hours, the consumption of the alcohol on the premises; during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel; during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Crime and Disorder
3 Members and their guests will be prevented from taking drinks from the premises in open containers.
4 The Licensee will ensure that bar staff are instructed on to serve alcohol to any member who appears to be intoxicated.
5 The Licensee will ensure that appropriate crime prevention notices are displayed
Public Safety
6 The fire brigade will be called at once to any outbreak of fire, however slight, and the details recorded in a Fire Log-book.
7 An adequate and appropriate supply of first aid equipment and materials will be available on the premises.
8 It is suggested that the following systems should be maintained and inspected by suitably qualified professional persons in accordance with any British Standards and at intervals recommended in national guidance. Records of such inspections should be kept and made available for inspection by authorised officers on request:
Building Electrical Installation
Emergency Lighting System
Fire Warning System
Gas boiler, calorifier or appliance
Oil fired boiler or appliance
Suspended ceilings
Portable fire fighting equipment
Temporary Electrical Installation
4. The Licensee will ensure that all exits and escape routes are clearly identified, kept free
from obstruction and available for immediate use in the event of an emergency during
licensable activities.
5. The Licensee will ensure that ‘Fire Action Notices’ are displayed in the licensed
premises.
Prevention of Public Nuisance
1 Noise or vibration will not emanate from the premises so as to cause a nuisance to nearby properties.
2 Noxious smells from the licensed premises will not be permitted so as to cause a nuisance to nearby properties and the premises will be properly vented.
3 Signs will be displayed near exits requesting members and guests to respect the needs of residents by leaving the premises quietly.
Protection of children from harm
4 Children must be accompanied by a responsible adult at all times they are present on the licensed premises.
5 All members of staff at the premises will seek ‘credible’ photographic proof of age evidence from any person who appears to be under the age of 18 and who is seeking to purchase or consume alcohol on the premises.
