Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
1 The premises will be managed in accordance with Club rules.
2 The Licensee will ensure that adequate and valid public liability insurance is in force and that a copy of the schedule is available for inspection by an authorised officer on request.
3. Conditions imposed by The Licensing Act 1964.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve,
11 a.m. to 11 p.m.
) On Sundays, other than Christmas Day or New Year’s Eve,
12 noon to 10.30 p.m.
) On Good Friday, 12 noon to 10.30 p.m.
) On New Year’s Eve, except on a Sunday, 10 a.m. to 11 p.m.
) On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.
) On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:
i) not exceed six and a half hours;
ii) not begin earlier than 12 noon;
iii) not end later than 10.30 p.m.
iv) provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v) not extend for more than three and a half hours after 5 p.m.
g) On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).
NB: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
4. The above restrictions do not prohibit:
) during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
) during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
) during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
) the supply to, or consumption by, any person of alcohol in any premises where they are residing.
The Prevention of Crime and Disorder
1 The Licensee will ensure that those persons who appear to be drunk or behave in a disorderly manner are not served alcohol.
2 The Licensee will provide/install and maintain CCTV equipment outside the premises in full working order. All recordings will be retained for at least 28 days and will be made available to an authorised officer of the Licensing Authority or Police on demand.
3 The Licensee will display any notices relating to crime prevention at the request of Suffolk Constabulary.
4 The Licensee will not adopt any drink promotion activities that undermine a policy of responsible drinking.
5 The Licensee will notify the local Fire Control Centre as soon as possible if the water supply to any hydrant, hose reel, sprinkler, drencher or other fire extinguishing installation is cut off or restricted.
Public Safety
6 The Licensee will ensure that all health & safety and fire precaution regulations are fully complied
with and appropriate control measures in place.
2 The Licensee will ensure that open drink containers (i.e. tins and bottles) will not be taken outside the premises.
3. The Licensee will ensure that the maximum permitted number of persons on the premise will not
exceed 300
4. The Licensee will ensure that the following systems are maintained and inspected by a suitably qualified professional person in accordance with the appropriate British Standard an at intervals recommended in national guidance, and will keep the records of such inspections available for inspection by authorised officers on request:
Electrical installation
Emergency lighting systems
Fire alarm systems
Gas boiler appliance
Oil fire boiler appliance
Suspended ceilings
Portable fire fighting equipment
Temporary electrical installations
5. The Licensee will ensure that an adequate and appropriate supply of first aid equipment and materials are available on the premises.
6. The Licensee will ensure that the Fire Brigade is called immediately in the event of a fire, however
slight, and the details recorded in a Fire Log-Book.
The Prevention of Public Nuisance
1 The Licensee will ensure that noise or vibration from music will not emanate from the premises so as to cause a nuisance to nearby properties.
2 The external area as per site plan attached to the application entitled Royal British Legion Felixstowe Site Plan, shall not be used after 23:30 hours.
3 After 23:30 hours all external doors and windows must be kept closed, other than for access and egress when amplified music and amplified speech is taking place.
4 The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties.
5. A responsible person shall monitor the music levels in accordance with any request by an authorised officer of the Council immediately and ensure that the volume is maintained at the reduced level.
The Protection of Children from Harm
5 All members of staff at the premises will seek ‘credible’ photographic proof of age evidence from any person who appears to be under the age of 18 and who is seeking to purchase or consume alcohol on the premises.
6 The Licensee will ensure that children under the age of 18 are accompanied at all times by an adult while they are on the premises.
7 The Licensee and/or staff will monitor AWP(s) to ensure non-use by under-18s. A sign confirming age prohibition will also be clearly displayed near the machine(s).
8 The Licensee will ensure that children under the age of 14 are not permitted in the indoor sports area.
