Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
1 The premises will be managed in accordance with the rules of the Club.
2 Conditions imposed by The Licensing Act 1964.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve,
10 a.m. to 11 p.m.
) On Sundays, other than Christmas Day or New Year’s Eve,
12 noon to 10.30 p.m.
) On Good Friday, 12 noon to 10.30 p.m.
) On New Year’s Eve, except on a Sunday, 10 a.m. to 11 p.m.
) On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.
) On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:
i) not exceed six and a half hours;
ii) not begin earlier than 12 noon;
iii) not end later than 10.30 p.m.
iv) provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v) not extend for more than three and a half hours after 5 p.m.
g) On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).
NB: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
3. The above restrictions do not prohibit:
) during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
) during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
) during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
) the supply to, or consumption by, any person of alcohol in any premises where they are residing.
Crime and Disorder
1 The Licensee will ensure that bar staff are instructed on to serve alcohol to any member who appears to be intoxicated.
2 The Licensee will ensure that notices are displayed advising members not to remove bottles and glasses from the premises.
3 The Licensee will ensure that adequate steps are in place (e.g. signage and/or sufficient staff on site) to ensure that customers leave the premises quietly.
Public Safety
1 The number of persons present numbers on the premises will not exceed:
In the Club as a whole 250 persons made up of:
Lounge Bar 160 persons
Function Room (including restaurant) 90 persons
2 The Licensee will ensure that at the point of access/egress to the premises a non-slip
surface ramp is provided for easy access.
3 The Licensee will ensure that when disabled people are present, adequate arrangements
are in place to enable their safe evacuation from the premises in the event of an
emergency.
4 The Licensee will ensure that all exits and escape routes are clearly identified, kept free from obstruction and available for immediate use in the event of an emergency during licensable activities.
5. The Licensee will ensure that access for emergency vehicles at the premises is kept
clear and free from obstruction at all times.
6. The Licensee will ensure that trained first aider(s) are on duty when the public are
present.
7. The Licensee will ensure that the following systems are maintained and inspected by a
suitably qualified professional person in accordance with the appropriate British Standard
an at intervals recommended in national guidance, and will keep the records of such
inspections available for inspection by authorised officers on request:
Emergency lighting systems
Fire alarm systems
Prevention of Public Nuisance
1 The disposal of rubbish and bottles will take place at times which will minimise noise to surrounding areas.
The Licensee will ensure the premises are properly vented, and that noxious smells from the licensed premises are not permitted and cause a nuisance to nearby properties.
2 The use of outside areas including the beer garden and external seating shall not be permitted after 23:30hrs.
3 There shall be; no live music, no playing of recorded music and no other musical entertainment of a similar description held outdoors unless previously agreed in writing with the Licensing Authority.
4 The volume of the amplification system shall be strictly controlled so that noise levels are non-intrusive at nearby residential properties.
5 The windows to the function room used for the playing of music shall be kept closed when musical entertainment (other than background music) is taking place.
6 The external doors to any function room used for the playing of music shall be kept firmly closed when musical entertainment (other than background music) is taking place.
7 In the event that additional ventilation is necessary to the function room, a detailed scheme shall be submitted to the Environmental Protection Section and only an approved scheme shall be fitted.
8 The windows on the west side of the building shall be closed during any form of musical entertainment, including music for dancing.
Protection of children from harm
The Licensee will ensure that the club rules are adhered to in respect of the non-admission of junior members to the bar area of the club premises.
9 The Licensee and/or staff will monitor AWP(s) to ensure non-use by under-18s. A sign confirming age prohibition will also be clearly displayed near the machine(s).
