Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
1. The premises will be managed in accordance with Club rules.
2. Conditions imposed by The Licensing Act 1964.
Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
) On weekdays, other than Christmas Day, Good Friday or New Year’s Eve,
10 a.m. to 11 p.m.
) On Sundays, other than Christmas Day or New Year’s Eve,
12 noon to 10.30 p.m.
) On Good Friday, 12 noon to 10.30 p.m.
) On New Year’s Eve, except on a Sunday, 10 a.m. to 11 p.m.
) On New Year’s Eve on a Sunday, 12 noon to 10.30 p.m.
) On Christmas day, as provided by the rules of the club and notified in writing by the chairman or secretary of the club to the chief executive of the justices for the petty sessions area in which the premises are. The said hours shall:
i) not exceed six and a half hours;
ii) not begin earlier than 12 noon;
iii) not end later than 10.30 p.m.
iv) provide for a break of at least 2 hours, including 3 p.m. to 5 p.m.;
v) not extend for more than three and a half hours after 5 p.m.
g) On New Year’s Eve from the end of permitted hours to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December).
3. The above restrictions do not prohibit:
) during the first twenty minutes after the above hours, the consumption of the alcohol on the premises;
) during the first twenty minutes after the above hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
) during the first thirty minutes after the above hours, the consumption of the alcohol on the premises by persons taking meals there if the alcohol was supplied as ancillary to the meals;
) the supply to, or consumption by, any person of alcohol in any premises where they are residing.
NB: A person shall be treated as residing in any premises, notwithstanding that he occupies sleeping accommodation in a separate building, if he is provided with that accommodation in the course of a business of providing board and lodging for reward at those premises and the building is habitually used for the purpose by way of annexe or overflow in connection with those premises and is occupied and managed with those premises.
Crime and Disorder
1 All members of staff at the premises will seek PASS accredited proof of age cards, photo-driving licences or passports as proof of age evidence from any person who appears to be under the age of 18 and who is seeking to purchase or consume alcohol on the premises.
Public Safety
2 The Licensee will ensure that the maximum permitted number of persons on the premise will not exceed 99.
Prevention of Public Nuisance
3 The Licensee will ensure that any external lighting provided will be positioned so as not to cause a nuisance to neighbouring or adjoining properties.
4 Any external area shall not be used by patrons after 23:30hrs.
5 After 23:30hrs all external doors and windows must be kept closed, other than for access and egress when amplified music is taking place.
6 The volume of the amplification system shall be strictly controlled so that noise levels are non-intrusive at nearby residential properties.
7 A responsible person shall monitor the music levels outside the building, and implement any changes in noise levels in accordance with any request by an authorised officer of the Council immediately and ensure that volume is maintained at the reduced level.
8 In the event that additional ventilation is installed within the premises, the proposed scheme shall be submitted to the Head of Health, and only a scheme approved by the Head of Health shall be installed at the premises and maintained in the approved form thereafter.
Protection of children from harm
9 The Licensee will ensure that children under the age of 16 are accompanied at all times by an adult while they are on the premises.
2. The Licensee and/or staff will monitor AWP(s) to ensure non-use by under-18s. A sign confirming age prohibition will also be clearly displayed near the machine(s).
