Additional Conditions

• Annex 1 - Mandatory Conditions

   

  Where a premises licence authorises the sale of alcohol, the licence must include the following conditions:

   

  1. (1)No supply of alcohol may be made under the premises licence -

   

           At any time when there is no designated premises supervisor in respect of the premises, or

           At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)               Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  2. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  3.  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  4.  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  5. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  6.  The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

   

  (b) customers are made aware of the availability of these measures.

   

• Annex 2 - Conditions Consistent with the Operating Schedule

   

  General Conditions

  -

   

  Crime and Disorder

   

  1.              The Licence holder/DPS shall implement the ‘Challenge 21’ scheme, ensuring prominent signage is displayed throughout the premises and all staff are trained in its operation.

   

  2.              The Licence holder/DPS shall set Video/CCTV equipment to record from the time that the premises open to the public until the premises close and all members of the public have left.

   

  3.              The Licence holder/DPS shall provide CCTV in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition.

   

  4.              The Licence holder/DPS shall ensure CCTV cameras encompass all ingress and egress to the premises, fire exits, outside areas, and all areas where the sale/ supply of alcohol occurs.

   

  5.              The Licence holder/DPS shall ensure CCTV Equipment must be maintained in good working order.

   

  6.              The Licence holder shall keep CCTV recordings for a period of no less than 28 days, and assess to either viewing of the footage, and or copies of the footage, are made available to Police or Local Authority officer on demand.

   

  7.              The Licence holder /DPS shall ensure an appointed member of staff is available and competent at downloading CCTV footage in a recordable format either disc, VHS, or electronic storage device, to the Police/Local Authority upon reasonable demand.

   

  8.              The Licence holder/DPS shall ensure the Recording equipment and tapes/discs/device is kept in a secure environment under the control of the DPS or other responsible named individual.

   

  9.              The Licence holder/DPS shall put up notices advising that CCTV has been installed on the premises so that they are clearly visible to the public within the licensed premises.

   

  10.              The Licence holder/DPS shall maintain a daily log report endorsed by signature, indicating the CCTV system has been checked and is compliant, in the event of any failings actions taken are to be recorded.

   

  11.              The Licence holder/DPS shall ensure that customer numbers are continually risk assessed, and effective control shall be exercised over occupancy levels in all areas of the premises so as to avoid overcrowding to an extent prejudicial to health and safety.

   

  12.              The Licence holder/DPS shall keep and maintain an incident book on the premises at all times. The book shall detail any incident/injury/ejection/refusals/drug misuse/seizure/age challenge. Such matters shall be timed, dated and signed by the author and produced to Police/Authorised Licensing Officers on demand.             

   

  13.              The Licence holder/DPS and all other staff shall ensure that no open bottles or vessels are taken off the premises by customers.

   

  14.              The Licence holder/DPS shall participate in the local pubwatch/nightsafe scheme. All individuals, without any exception, subject to a local PubWatch ban will be refused entry and excluded from the premises for the entire duration of their ban. All staff will be alerted to the banned persons by the Pub Watch representative and report any attempt that such persons make to gain access to the premises to the Police.

   

  15.              The Licence holder/DPS shall implement an ejection policy ensuring all instances of drunkenness, disorder, drug use or violence are challenged, resulting in the ejection or retention of the individual(s) and under serious circumstances, consideration shall be given to their permanent exclusion from the premises in future.

                All such instances must be notified to the Police at the time of happening or as soon as possible thereafter using the appropriate method, emergency or non-emergency contact dependant on the circumstances.  Where an offence of violence has been committed the premises management will take all reasonable steps to identify the offender and pass the identity to the Police as soon as is reasonably practicable. An incident book entry will be made on all occasions; timed, dated and signed by a member of staff.

   

  16.              The Licence holder shall ensure that drinks are only available for consumption from plastic vessels or toughened glass.

   

  17.              The licence holder/DPS will ensure that all staff engaged in the sale of alcohol to be given suitable training in responsible alcohol retailing.  Training records shall be kept on the premises and produced to the Police and authorised Local Authority Licensing Officers on demand. For the avoidance of doubt this training can be administered in-house in accordance with the relevant criteria. Training will be reviewed on a six monthly basis.

   

  18.              The licence holder/DPS will ensure that empty glasses and bottles, or other drinking vessels shall be regularly collected so as to ensure no accumulation in areas where the public have access.

   

  19.              The licence holder/DPS will ensure that the toilet areas will be checked whilst the premises are open for licensable activities during the evenings.  The toilet areas will be checked at least every hour that the premises is open for licensable activities on every Friday and Saturday night, and every Sunday proceeding any bank holiday, on Christmas and New years Eve, and for any other special event.  A ‘Toilet-check’ log sheet will be endorsed to this effect and made available to Police and Local Authority Licensing Officers on demand

               

  20.  The license holder/DPS shall ensure no under 18-year-olds are on the premises without being accompanied by a suitable appropriate adult.

   

   

  Public Safety

   

  1         The Licensee will ensure that all exits and escape routes are clearly identified, kept free from obstruction and available for immediate use in the event of an emergency during licensable activities.

   

  2.              The Licensee will ensure that the following systems are maintained and inspected by a suitably qualified professional person in accordance with the appropriate British Standard an at intervals recommended in national guidance, and will keep the records of such inspections available for inspection by authorised officers on request:

           Fire alarm systems

   

  Prevention of Public Nuisance

   

  1         The Licensee will take steps to ban customers who cause noise disturbance when leaving the premises.

   

  2.              The Licensee will ensure that adequate steps are in place (e.g. signage and/or sufficient staff on site) to ensure that customers leave the premises quietly.

   

  3.              The outside seating area as detailed on the accompanying plan attached in Annex 4 shall not be used after 23:30hrs.

   

  4.              All windows and doors to the premises, shall be kept closed other than for access and egress at all times when there are performances of live music, when recorded music, other than in the form of amplified background music from a radio, CD player or other similar devices, is being played, and when there is other musical               entertainment of a similar description, for example a karaoke or a disco.

   

  5.              The volume of the amplification system for any description of musical entertainment shall be strictly controlled so that noise levels are non-intrusive at the boundaries of nearby residential properties.

   

  6.              A responsible person shall monitor the music levels outside the building, and implement any changes to reduce the noise levels in accordance with any request by an               authorised office of the Council immediately and ensure that volume is maintained at the reduced level.

   

  Protection of children from harm

   

  2         The Licensee and/or staff will monitor AWP(s) to ensure non-use by under-18s. A sign confirming age prohibition will also be clearly displayed near the machine(s).
