ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1.The premises licence holder, DPS, management and staff will constantly assess any risks to the licensing objectives. They will work in partnership with the authorities and local people alike in this respect. The staff will be properly authorised, equipped, trained, and motivated in this task.
2. There will be:
2.1 A Refusals log in place
2.2 A written notice of ‘authority’ record for all staff who sell alcohol.
2.3 Comprehensive training for staff in the main requirements of the Licensing Act 2003, the specific measures, and conditions in place to promote the Licensing Objectives and the staff roles and responsibilities. Such records shall be available for inspection by the responsible authorities.
3. Contact details of the Designated Premises Supervisor available to staff and to the authorities
4. No more than 20% of the retail space shall be available for the display/sale of alcohol products.
The prevention of crime and disorder
1: Ahmad Salari (or any alias name he may use now or in the future) is prohibited from any involvement in the business whatsoever either paid or unpaid.
2: Ahmad Salari (or any alias name he may use now or in the future) is prohibited from being on the premises at any time it is open for licensable activity.
3. The management and staff will take all necessary steps to ensure that the premises remain free from crime and disorder and neither creates nor contributes to crime and disorder.
4. This will include:
4.2 An effective CCTV system
4.3 The CCTV coverage shall be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition.
4.4 Cameras shall encompass all ingress and egress to the premises and all areas where the sale/supply of alcohol occurs.
4.5 An external camera shall cover the front entrance to the premises.
4.6 Equipment shall be maintained in good working order and checked every 12 months.
4.7 The system shall record in real time and operate whilst the premises are open for licensable activities.
4.8 The recordings shall be kept available for a period of 28 days and handed to Police or Local Authority Officer on request.
4.9 The Recording equipment shall be kept in a secure environment under the control of the Premises Licence Holder or other responsible named.
Public safety
1. The management and staff will have an effective policy to maintain a safe venue for customers and staff. Any risk to safety will be assessed before the premises are opened to the public each day and throughout the hours of operation. The DPS will liaise with the authorities to ensure that all aspects of public safety are adhered to.
2. The policy will include:
2.2 Appropriate firefighting equipment being installed and maintained at the premises and staff trained in its use.
2.3 Fire risk assessments being undertaken and acted upon in accordance with current recommendations and requirements.
2.4 Effective lighting maintained and operated to ensure the safety of the public and staff.
2.5 The approved arrangements at the premises, including means of escape provisions, emergency warning equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.
2.6 The means of escape provided for the premises shall be maintained unobstructed, free of trip hazards, be immediately available and clearly identified in accordance with the plans provided.
The prevention of public nuisance
The premises licence holder shall ensure:
1. The shop and public areas nearby are kept free from litter associated with the operation of the shop.
2. Any noise, light pollution and any other potential nuisance is monitored and kept to an acceptable level.
3. Deliveries and waste removal are undertaken at a time and in a manner that does not cause disturbance to residents or businesses.
The protection of children from harm
1. The premises will be maintained as suitable for all ages. There will be an effective age verification policy in accordance with the mandatory code. This policy will be one of Challenge 25 for all age restricted products and include:
1.1 The display of notices and signage relating to the policy at the entrance to the premises and at the point of sale.
1.2 These notices will indicate that any customer not appearing to have reached the age of 25 will be required to produce appropriate identification proving that they have turned 18 before being served.
1.3 Appropriate ID will be a passport, photo driving licence, PASS accredited proof of age card or other reliable photo-ID that is recommended and approved for acceptance by the police or other authorities.
1.4 Staff shall be trained in all aspects of responsible alcohol retailing, in particular the Protection of Children including the Challenge 25 policy and the identification and refusal of potential ‘proxy’ purchasers.
1.5 Staff training will occur before a staff member is authorised to sell alcohol within the premises.
1.6 Staff training will be recorded with regular refresher sessions and signed off by the DPS and/or Premises Licence Holder.
1.7 Staff training records will be available for inspection by the police or other responsible authority upon request.
1.8 A refusals log will be kept and reviewed regularly by the DPS and made available for inspection by the police and an appropriate local authority representative.
1.9 Staff will take reasonable steps to ensure that children and young people do not congregate inside or outside the premises.
