ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
General
1. All staff members engaged, or to be engaged, in selling alcohol on the premises shall receive full training pertinent to the Licensing Act, specifically in regard age-restricted sales, and the refusal of sales to persons believed to be under the influence of alcohol or drugs.
2. Induction training must be completed prior to engaging in any sale of alcohol. Refresher training shall be conducted thereafter at intervals of no more than twelve weeks.
3. All restricted sales training undertaken by staff members shall be fully documented and signed by the employee and the DPS. All training records shall be made immediately available upon request to the Local Authority Licensing Officers and Suffolk Police Officers or Licensing staff.
4. The premises licence holder shall ensure that at all times when the premises are available for any licensable activity, that there are sufficient competent staff on duty at the premises for the purpose of fulfilling the terms and conditions of the licence and for preventing crime and disorder.
5. The Licensee shall ensure that all staff will undertake training in their responsibilities in relation to the sale of alcohol, particularly with regard to drunkenness and underage persons.
6. Records will be kept of training and refresher training.
Prevention of crime and disorder
1. Any incidents of a criminal nature that may occur on the premises will be reported to the Police, to include the misuse of drugs
2. Any person found to be in possession of any drugs will be barred indefinitely
3. The Licensee will be part of the Night safe Group
4. Digital CCTV and appropriate recording equipment to be installed in accordance with Home Office Guidelines relating to UK Police Requirements for Digital CCTV System and operated and maintained throughout the premises internally and externally to cover all public areas, including the entrance to the premises.
4. The system shall be on and recording at all times the premises licence is in operation.
5. The CCTV cameras and recording equipment must be of sufficient quality to work in all lighting levels inside the premises at all times. CCTV footage will be stored for a minimum of 31 days.
6. The management will give full and immediate cooperation and technical assistance to the Police in the event that CCTV footage is required for the prevention and detection of suspected or alleged crime.
7. The CCTV images will record and display dates and times, and these times will be checked regularly to ensure their accuracy.
8. Subject to Data Protection guidance and legislation, the management of the premises will ensure that key staff are fully trained in the operation of the CCTV and will be able to download selected footage onto a disk or a suitable storage device for the police without difficulty or delay and without charge to Suffolk Police.
Any breakdown or system failure will be notified to the police immediately & remedied as soon as practicable.
9. It should be noted that Lewis Tanner will not be permitted on the premises during licensable activity.
Public safety
1. All staff will be trained in essential public safety, ensuring fire exits are kept clear, fire extinguishers in their correct positions, and CCTV switched on and in full working order at all times.
2. Any slipping or tripping hazards identified will be reported to the duty manager and rectified as expediently as possible.
3. A comprehensive public safety check will be completed by an employee trained and designated to do so at least every 24 hours.
4. Appropriate fire safety procedures are in place including fire extinguishers (foam, H20 and CO2), fire blanket, internally illuminated fire exit signs, smoke detectors and emergency lighting (see enclosed plan for details of locations). That all appliances are inspected annually. All emergency exits shall be kept free from obstruction at all times.
No internal or exit doors to be locked during opening hours
Prevention of public nuisance
1. All windows and external doors to the outside area will be closed after 23.00 hours.
2. Notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and businesses and leave the area quietly.
3. The number of persons permitted in the balcony area at any one time shall not exceed 60 persons.
4. Premises staff on duty shall ensure that any guests drinking and/or smoking in the outside area do so in an orderly manner so as not to cause any disturbance to local residents.
5. External lighting in the outside area will be switched off no later than 23.00.
6. No fumes, steam or odours shall be emitted from the premises so as to cause a nuisance to any persons living or carrying on business in the area.
7. All waste shall be properly presented and placed out for collection on appointed collection days/times only.
8.All disruptive customers will be asked to leave
Protection of children from harm
1.All staff will be trained for underage sales prevention regularly
2.The premises will operate an age verification policy set at a minimum of 25 years, whereby any person attempting to buy alcohol who appears to be under the specified age will be asked for photographic ID to prove their age.
3. Signage advertising the “Challenge” policy will be displayed in prominent locations in the premises and shall include the point of sale and the area where the alcohol is displayed, as a minimum.
4.The recommended forms of ID that will be accepted are passports, driving licences with a photograph or Citizen Card or validated proof of age cards bearing the “PASS” mark hologram.
