Additional Conditions

• Annex 1 - Mandatory Conditions

   

  Where a premises licence authorises the sale of alcohol, the licence must include the following conditions:

   

  1. (1)No supply of alcohol may be made under the premises licence -

   

           At any time when there is no designated premises supervisor in respect of the premises, or

           At a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (2)               Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  2. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  3.  The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  4.  The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  5. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  6.  The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml; and

   

  (b) customers are made aware of the availability of these measures.

   

• Annex 2 - Conditions Consistent with the Operating Schedule

   

  General Conditions

  1.              The Licensee will produce a Health & Safety report for all potential public hazards and monitor compliance.

  2.              The Licensee will ensure that:

  Public Liability Insurance is provided up to £5m.

  Security staff and marshals are present on the day to keep public order and monitor crowd safety.

         The Police and Fire Service are notified of the event. St John Ambulance will be notified and present on site during opening hours.

   

  Crime and Disorder

  1.              The Licensee will:

  Ensure that the Police are notified in writing at least one month prior to the event taking place.

  Ensure that excessive ordering of alcohol is not allowed when last order have been called.

  Not adopt any drink promotion activities that undermine a policy of responsible drinking.

  Ensure that at all times when the premises is open for any licensable activity there are sufficient, competent staff on duty at the premises for the purpose of fulfilling the terms and conditions of the license and for preventing crime and disorder.

  Ensure that non alcoholic drinks are available at all times on the premises.

  Use door supervisors licensed by the SIA and employed from a reputable company. The door supervisors will ensure that they:

  o              Manage the entry points on to the premises and exclude customers who appear to be drunk or disorderly.

  o              Maintain good order both inside and outside the premises and eject customers who appear drunk or disorderly.

  o              Control alcohol being brought on to the premises.

  o              Assist police if they are called on to the premises.

  Report all instances of crime and disorder to Suffolk Constabulary and ensure that a record of the incident is entered in a log book which must be kept on the premises during licensable activities.

  Ensure that customers can only enter and exit via managed entry points and that sufficient fencing is erected to prevent unauthorised entry to the premises.

  Adopt a proof of age scheme (“Challenge 21”) and deploy a coloured wrist band system to highlight underage persons on the premises.

          Provide the Police with a radio for direct contact with premises staff.

   

  Public Safety

  1.              The Licensee will:

  Produce a Health & Safety report and perform risk assessment throughout the day.

  Ensure that all stall holders provide proof of official license and comply with the risk assessments made on the day of the event.

  Ensure that all cabling or trip hazards are made safe and that all erections are secure and fenced off.

  Ensure that lighting is turned on in public areas when it gets dark for safe use of public conveniences and the disposal of the crowd when the event finishes.

  Ensure that first aid is on site during opening hours.

  2.              The Licensee will comply with the following requirements:

  1         Documentation

  1.1 Risk Assessment.

  An event Risk Assessment shall be carried out (as defined in the Management of Health and Safety at Work Regulations 1999) and the significant findings submitted to the Responsible Authority for Public Safety 30 days prior to the event each year.

  1.2 Major Incident Plan.

  A Major Incident Plan shall be made prior to the commencement of the event each year and arrangements put in place to ensure that the plan can be implemented in the event of an emergency.

    1.3 Management Plans.

  The Licence Holder shall prepare plans of action to be taken in the event of the following situations arising:

  1.3.1 Stopping the music during the course of the event;

  1.3.2 Event cancellation.

  1.4 Site Plan.

  The site shall be laid out in accordance with a site plan and a copy of the plan shall be made available by the License Holder for inspection by the Responsible Authority for Public Safety upon request.

  2. Standards

  2.1 Guidance.

  The Licensee shall have regard to the publication ‘The Event Safety Guide - A Guide to Health, Safety and Welfare at Music and Similar Events’ (ISBN 0-7176-2453-6), or any subsequent revision thereof, when determining safety arrangements for the event.

  3. Crowd Safety and Premises Standards.

  3.1 Stewarding.

  The Licensee shall provide a sufficient number of appropriately trained and/or suitably instructed stewards to ensure public safety on the Licensed Premises.

  3.2 Medical and First Aid Facilities.

  The Licensee shall ensure that Medical and First Aid Provision shall be determined by an assessment of activities and arrangements in place at the event and provided accordingly.

  3.3 Electrical Systems.

  3.3.1 All temporary electrical installations on the site shall be checked by a competent person to ensure they have been installed safely.

  3.3.2 All electrical equipment shall be installed, so far as is reasonably practicable, to prevent interference with it by unauthorised persons.

  3.4 Lighting.

  The Licensee shall ensure that adequate artificial lighting is provided during the hours of darkness to enable persons to move around the Licensed Premises safely.

  3.5              Temporary Structures

  The Licensee shall ensure that any temporary structure is erected in accordance with the approved plans and is safe for the intended use.

  3.6 Glass.

  The Licensee shall take all reasonable steps to minimise the presence of glass containers on the Licensed Premises.

  4. Catering.

  4.1

  A list of all food businesses involved in the preparation, handling and/or sale of food on the Licensed Premises shall be made available by the License Holder for inspection by the Responsible Authority for Public Safety.

  5. Vendors.

  5.1

  The Licensee shall ensure, so far as is reasonably practicable, that all vendors on the Licensed Premises carry on their activities without compromising public safety.

  6. Sanitary Facilities.

  6.1

  The Licensee shall provide sufficient toilet facilities for persons on the Licensed Premises and shall maintain those facilities in a hygienic condition. Toilet facilities shall be sited in suitable locations.

  6.2

  The Licensee shall provide sufficient means for persons on the Licensed Premises to maintain adequate personal hygiene.

   

  Prevention of Public Nuisance

  1.              The Licensee will monitor the activities of the public at all times and (if appropriate) remind them of their public responsibilities.

  2.              The Licensee will comply with the following requirements

  3.              The Environmental Protection team at Suffolk Coastal District Council shall be notified in writing no later than14 Days prior to the event taking place

  4.  The Local Authority Environmental Protection team shall be notified of the date and time of any sound check/ sound propagation test to be carried out prior to the event. Notification should be at least 24 hours prior to the sound check/sound propagation test taking place.

  5. The volume of the amplification system for any description of musical or other amplified entertainment shall be strictly controlled so that noise levels do not exceed the levels set out in the ‘Code of Practice on Environmental Noise Control at Concerts’ for music events at ‘other urban or rural venues’ holding 1 to 3 events per calendar year. These levels shall be as follows:

  The LAeq of the music noise, known as the music noise level (MNL), arising from the performance of live music, recorded music or plays during any permitted event shall not exceed 65dB (A) over a 15 minute period when measured 1 metre from the facade of any noise sensitive properties.

  6. A responsible person shall monitor the noise levels at the boundaries of nearby residential properties, and implement any changes to reduce the noise levels in accordance with any request by an authorised officer of the council immediately and ensure that volume is maintained at a reduced level.

  7.  All Live and recorded music and the use of public address systems shall be finished by 23:00

   

  Protection of children from harm

  1.              The Licensee will ensure that all marshals and security staff are briefed on the procedure for lost children and that a central marshal collection point is available all day for public enquires related to child safety.

   

  2.   The Licensee will adopt a proof of age scheme (“Challenge 21”) and deploy a coloured wrist band system to highlight underage persons on the premises.
