Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  Where a premises licence authorises the sale of alcohol, the licence must include the following conditions:

   

  1. (1) No supply of alcohol may be made under the premises licence -

   

           At any time when there is no designated premises supervisor in respect of the premises, or

           At a time when the designated premises supervisor does not hold a personal licence, or his personal licence is suspended.

   

  (2)               Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  2. (1) The responsible person must ensure that staff on relevant premises do not carry

       out, arrange or participate in any irresponsible promotions in relation to the premises.

   

       (2) In this paragraph, an irresponsible promotion means any one or more of the following

  activities, or substantially similar activities, carried on for the purpose of encouraging the

       sale or supply of alcohol for consumption on the premises-

  (a) games or other activities which require or encourage, or are designed to require or

  encourage, individuals to-

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or

  discounted fee to the public or to a group defined by a particular characteristic in a

  manner which carries a significant risk of undermining a licensing objective;

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage

  or reward the purchase and consumption of alcohol over a period of 24 hours or

  less in a manner which carries a significant risk of undermining a licensing objective;

  (d) selling or supplying alcohol in association with promotional posters or flyers on, or

  in the vicinity of, the premises which can reasonably be considered to condone,

  encourage or glamorise anti-social behaviour or to refer to the effects of

  drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than

  where that other person is unable to drink without assistance by reason of disability).

   

  3. The responsible person must ensure that free potable water is provided on request to

  customers where it is reasonably available.

  4. (1) The premises licence holder or club premises certificate holder must ensure that

      an age verification policy is adopted in respect of the premises in relation to the sale or

      supply of alcohol.

     (2) The designated premises supervisor in relation to the premises licence must ensure

      that the supply of alcohol at the premises is carried on in accordance with the age

      verification policy.

      (3) The policy must require individuals who appear to the responsible person to be under

      18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a) a holographic mark, or

  (b) an ultraviolet feature.

  5. The responsible person must ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on

  the premises (other than alcoholic drinks sold or supplied having been made up in

  advance ready for sale or supply in a securely closed container) it is available to

  customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of

  alcohol to be sold, the customer is made aware that these measures are available.”

   

  6.  A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  6.1 For the purposes of the condition set out in paragraph 1

   

                    (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

   

                   (b) “permitted price” is the price found by applying the formula-

   

  P = D + (D×V)

  where-

   

  (i)              P is the permitted price,

   

  (ii)              D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

   

  (iii)              V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence

   

  (i)              the holder of the premises licence,

   

  (ii)              the designated premises supervisor (if any) in respect of such a licence, or

   

  (iii)              the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

  6.2  Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this   paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  6.3 (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of

  paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

  EXHIBITION OF FILMS

   

  1)      Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section -

   

  2)      Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.

   

  3)      Where -

   

  )          the film classification body is not specified in the licence, or

  )          the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question, admission of children must be restricted in accordance with any recommendation made by that licensing authority.

   

  4)              In this section -

   

  “children” means persons aged under 18; and

  “film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c.39) (authority to determine suitability of video works for classification).

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General

  1. Visitors (except residents) shall vacate the premises by 00:30 hours or 01:30 if an event takes place within the mansion or on New Year’s Eve.

  2. The premises will be open to residents 24 hours a day, 7 days a week.

  3. All staff will receive training so that they are aware of the premises licence and the requirements to meet the four licensing objectives with attention to:

  -              No selling of alcohol to underage people

  -              No drunk and disorderly behaviour in the premises area

  -              Vigilance in preventing the use of illegal drugs.

  -              No violent and antisocial behaviour

  -              No harm to children

  4. Staff training records will be kept, and refresher training will be undertaken with staff on a regular basis. Staff training records will be made available upon request to an officer of the local authority and or the Police.

   

  Prevention of crime and disorder

  1. A named responsible person will be present throughout events to oversee safe and orderly behaviour.

   

  Public safety

  1. The Licence Holder shall ensure that a general Risk Assessment and Fire Risk Assessment is produced for each event as well as an Event Management Plan for each outdoor event. Appropriate steps will be taken to minimise any problems/issues identified.

  2. The Licence Holder shall ensure that a suitable safety briefing is provided to all staff before an event.

  3. All equipment to be well maintained, all electrical equipment will be PAT tested regularly.

  4. All fire exits, and gangways will be kept clear and all fire extinguishers to be checked and/or replaced annually.

  5. There shall be clear traffic signage in place as well as a traffic management plan.

  6. The licence Holder shall ensure that health & safety rules are observed and that there is adequate insurance cover.

  7. Provide the Food and Safety Team with the name, address, and contact details of the promoter/organiser of an event, being held at Glemham Hall, where more than 5000 people will attend over the period of the event, at least 90 days before the event.

  8. Supply the Food and Safety Team with an Event Management Plan applicable to an event, being held at Glemham Hall, where more than 500 people are expected to attend, at least 28 days before the event.

  9. Supply the Food and Safety Team with health and safety risks assessments applicable to an event, being held at Glemham Hall, where more than 500 people are expected to attend, at least 28 days before the event.

  10. For all events being held at Glemham Hall, the event organiser must ensure that all food outlets are registered with a local authority.

   

  Prevention of public nuisance

  1. Litter shall be regularly collected and disposed of in adequate waste receptacles.

   

  Noise Management Plan

  1. A Noise Management Plan shall be provided to the reasonable satisfaction of East Suffolk Council Environmental Protection Team at least 30 days prior to any ‘Large Scale Music Event’, which shall be defined as an event held for 1000 people or more (excluding staff) which has as its sole or primary focus the playing/performance of music to an audience.

  This plan shall identify how noise arising from the event will be effectively controlled so as to prevent public nuisance and show full compliance with licence conditions.

   

  In particular the noise management plan shall include the following details.

  1. A scale plan of the site indicating the main stage(s) and where noise will arise indicating their orientation and the location of amplification equipment and audience.

  2. Full details of the regulated entertainment including start and finish times.

  3. The Acoustic Consultancy or Noise Management Service to be used.

  4. Agreed sound levels with the Environmental Protection Team at East Suffolk Council.

  5. Measures to be taken prior to the event in respect of noise mitigation, (i.e., agreement of noise monitoring points, noise propagation tests and analysis, background sound level survey, resident letter drop).

  6. Arrangements for liaising with East Suffolk Council Environmental Protection Team in the lead up to, during and after the event.

  7. Noise Risk Assessment for staff and members of the public who may be exposed to hearing damage, including target sound levels at front of house.

  8. Other noise emissions at the event, (i.e., fireworks, pyrotechnics, funfairs etc) including timings and duration.

  9. Control of unauthorised noise on site (i.e., private parties).

  10. Over run strategy.

   

  General Requirements:

  1. Large Scale Music Events shall take place on no more than 7 days in any one calendar year.

  2. There shall be no more than 1 Large Scale Music Event in any calendar month. This will include the Folk East event hosted on site (under a separate premises licence) for so long as that event continues to take place at the premises. 

  3. All systems of sound amplification and reproduction through the public address system shall remain under the control of the Premises Licence Holder. Such control may be via a Licensing Compliance Officer or appointed Acoustic Consultant. The only exception to this is where an authorised officer of the Licensing Authority or the emergency services, in accordance with the Emergency Contingency Plan, has assumed the control of the system.

  4. All sound amplification systems under the control of the Premises Licence Holder shall not be used outside of the permitted hours for regulated entertainment, except for emergency announcements relating to public order and safety.

  5. Noise from other sources on site that are under the control of the Premises Licence Holder, but which do not fall within the description of regulated entertainment (e.g., mobile generators and litter and waste removal activities) shall not be audible such as to cause a nuisance within any noise sensitive properties between the hours of 23:00 and 08:00.

  6. The Licensee shall ensure that no noise nuisance is caused by non-licensed sound amplification systems during music festivals or other events where guests stay on site overnight.

   

  Prior to a Large Scale Music Event:

  7. Amplified entertainments provided in the course of a Large Scale Music Event shall be subject to control by a comprehensive "Noise Management Plan" prepared by, or on behalf of the applicant, which will be reviewed by the Environmental Protection Team at East Suffolk Council prior to the commencement of the event and which shall:

  a) Cover all items listed at general condition 1 above.

  b) Outline the methodology used for calculating and predicting music noise levels arising from the event at all identified noise sensitive receptors around the site to include the nearest independent noise sensitive dwelling.

  c) Set appropriate music noise levels as measured outside any identified noise sensitive properties during the course of the event. The identified noise sensitive properties where the music noise levels are to be measured are to be agreed in writing with an Authorised Officer from East Suffolk Council Environmental Protection Team and inserted within the Noise Management Plan.

  d) Set out details of the methods proposed to be used to field-test (and make any necessary adjustments to) the modelling used to predict sound propagation from the event to the noise sensitive receptors identified, after the amplification equipment has been set up but prior to the commencement of the event.

  e) Set out details, including timings and parameters to be measured, of the monitoring to be undertaken by a competent person, at representative noise sensitive receptors throughout the duration of the event, to verify compliance with the music noise levels set out in the Noise Management Plan (as described at point b above).

  f) Set out details of the proposed arrangements for dealing with any instances where the maximum noise levels (as described at point b above) are exceeded as determined by the proposed monitoring, in a timely and effective manner.

  g) Set out contact details for responsible person/s capable of exercising control over noise impacts in a timely manner, where necessary.

  h) Set out how to achieve and demonstrate compliance with any standards/requirements in place from time to time in relation to controlling noise or any reasonable requirements agreed in writing with the Environmental Health Officer as part of the Noise Management Plan.

  8. At least three weeks prior to the start of any Large Scale Music Event, the Premises Licence Holder shall advertise a Noise Complaint Hotline telephone number that will be available for the duration of that event.

  9. The adverts shall be in the form of a mail drop to all properties within a 3 Km radius of the site and be available on the venue website.

  10. All operations involved in the erection of the stages and all other temporary structures for music festivals or music concert type events held on the premises licence application site shall only take place between the hours of 08:00 and 23:00.

  11. A noise propagation test shall be undertaken prior to the start of any Large Scale Music Event in order to set appropriate control limits at the sound mixer positions. The sound systems for the Event shall be configured and operated in a similar manner as intended for the event. The sound source used for each test shall be similar in character to the music likely to be produced during the Event. The Environmental Protection Team at East Suffolk Council shall be notified of the noise propagation test at least 1 week before it takes place to allow attendance by Environmental Officers where possible. The noise limits set shall be used for the duration of the Event.

   

  Noise control at the Large Scale Music Event:

  12. Rehearsals and any additional essential sound checks shall only be permitted during the hours permitted for the performance of regulated entertainment. No musical entertainment shall be permitted outside of these hours.

  13. The licensee shall ensure that their published Noise Complaint Hotline telephone number is staffed and responded to for the duration of any music festival or music concert type event.

  14. The Licensee or their appointed acoustic/noise control experts shall undertake noise monitoring during the course of any Large Scale Music Event to ensure compliance with the music noise levels as set within the Noise Management Plan.

  15. The Licensee and any appointed Sound Control Engineers shall comply with all reasonable requests made by an Authorised Officer of East Suffolk Council Environmental Protection Team to reduce the music noise level in order to prevent public nuisance. Compliance with any such reasonable instruction shall be implemented as soon as possible.

  16. Records shall be made and retained of all monitoring and testing of noise levels undertaken in connection with the Noise Management Plan and shall be made available to the Environmental Protection Team at East Suffolk Council upon request.

   

  After the Large Scale Music Event:

  17. All operations involved in the dismantling of the stages and all other temporary structures on the premises licence application site shall only take place between the hours of 08:00 and 23:00.

  18. All details and measurement results from checks and sound level monitoring undertaken in fulfilment of the Noise Management Plan shall be made available for examination upon request by the Environmental Protection Team at East Suffolk Council and, in any case, retained and forwarded to the local authority within 28 days of the conclusion of the Event.

   

  Events other than Large Scale Music Events

  19. The volume of the amplification system used in connection with any description of regulated entertainment to events other than Large Scale Music Events shall be controlled such that the noise levels do not cause a nuisance at any nearby residential property.

   

  Protection of children from harm

  1. All children under 16 years of age to be accompanied by a parent and or another responsible adult (over the age of 18 years of age) and they are to be always supervised.

  2. The 'Challenge 25' scheme shall be implemented, prominent signage will be displayed at all areas where alcohol is supplied. The Licence Holder shall ensure that any person selling or supplying alcohol at the premises, asks for photographic proof of ID document where they have reason to suspect that the individual may be under 25 years of age.

  3. Educational visits to be supervised by teachers/tutors.

  4. Basic DBS checks shall be performed, where necessary.
