Annex 2 - Conditions Consistent with the Operating Schedule
General Conditions
I will ensure strong management controls and effective training of all staff to make sure they are aware of the licensing objectives and in particular ensure: no underage drinking, no drunkenness on the premises, no use of drugs, no violent and antisocial behaviour and protect children from harm.
Locations/provision of fire safety and other safety equipment will be subject to change in accordance with the requirement of the responsible authorities or following a risk assessment.
Training staff in relation to the Licensing Act 2003; records will be kept
Will ensure provision of sufficient staff levels to secure the safety of the premises and customers
I will ensure management and monitoring of people (including staff and patrons) arriving and leaving the premises.
I will only accept accredited proof of age cards and photo driving licences/passports.
Crime and Disorder
I will use or employ door supervisors at all times when a licensable activity is being carried out and I consider them necessary to:
Prevent admission of and ensure departure from the premises of drunk and disorderly persons without causing further disorder
Keep out excluded individuals (subject to court or pubwatch bans)
Search and exclude persons suspected to carry illegal drugs or offensive weapons; or
Maintain an orderly queue outside venue.
I will ensure that any door supervisors used are registered by the Security Industry Authority
I will make sure that a female supervisor is available if searches are to be made on female customers.
Where there are 5 or more door supervisors, at least one will be female.
Where glass bottles are used, they will be retained or disposed of on the premises.
No customers will be admitted or permitted to leave when carrying open bottles or glasses.
I will ensure that the consumption of alcohol is restricted to the areas identified on the plan attached to the operating schedule.
I will ensure that the maximum occupancy of the licensed premises is restricted at any one time to 200.
I will ensure that any person selling or supplying alcohol under the authority of the personal licence holder asks for photo ID proof of age where they believe the individual is under 18 years of age.
I shall promote a designated drivers scheme
I will adopt and comply with the British Beer and Pub Associations Guidelines on On-Trade promotions.
I will implement a policy agreed by the police and local authority, and take guidance from the ‘Safer Clubbing Guide’.
I will ensure that a secure deposit box is kept on the premises for the retention of confiscated items and ensure that he police are advised of any items which require safe disposal.
I shall ensure that public information notices about crime and disorder issues are displayed at the request of the Council of Suffolk Constabulary, for example the customer code of conduct.
I will display any conditions of entry to the premises in the vicinity of any entrance to the premises.
I will ensure that there is no audience participation in regulated entertainment which includes striptease, lap-dancing or similar entertainment.
I will be responsible for the disposal of waste on the premises and make provision for the emptying of litter bins in the vicinity of the premises.
I will keep a refusal log on the premises for those who have been refused alcohol.
I will ensure lighting is provided outside the premises during the hours of darkness when any licensable activity takes place on the premises.
Public Safety
I will make sure that where chairs and tables are provided; internal gangways and fire exits are kept unobstructed
I will make sure fire exits and escape routes are maintained to ensue they are not obstructed, in good order with non-slippery and even surfaces, free of trip hazards and clearly identified.
I will make sure that all exit doors are easily openable and regularly check they function. A log will be kept.
I will make sure that any hangings, curtains and temporary decorations are arranged so as not to obstruct exits, fire safety signs or fire fighting equipment.
I will make sure that notices detailing the action to be taken in the event of a fire or other emergencies, including how the fire brigade should be summoned, are prominently displayed and protected from damage and deterioration.
The fire brigade will be called at once to any outbreak of fire, however slight, and the details recorded in a fire log book.
Access for emergency vehicles will be kept clear and free from obstruction.
In the event of an emergency, patrons will be made aware of procedures for exit. When disabled people are present, adequate arrangements will be in place to enable their safe evacuation.
I will make sure that there is adequate and appropriate supply of first aid equipment and materials on the premises.
I will make sure that there is at least 1 trained first aider on duty when the public are present and that their duties are clearly defined.
I will make sure that the edges of treads of steps and stairways are maintained so as to be conspicuous.
In the absence of adequate daylight, I will make sure that the lighting in any area accessible to the public is fully operational.
I will not alter emergency lighting without prior notification to the licensing authority.
Safety checks will be carried out before the admission of the public/guests; details of such checks will be kept in a log book.
I will make sure that emergency lighting batteries are fully charged before admission of the public.
In the event of failure of normal lighting, where the emergency lighting has a capacity of one hour, I will ensure the evacuation of the premises within 20 minutes; where the capacity is three hours I will ensure the evacuation of the premises within one hour.
I will make sure that fire safety signs are adequately illuminated.
I will not provide temporary electrical wiring and distributions systems without prior inspection by a qualified electrician. I will ensure that any temporary electrical wiring systems and distribution systems comply with the recommendations of BS7671 or where applicable BS7909. These will be inspected and certified by a competent person before they are put to use.
I will make sure that the following systems, when present at the premises, are maintained and inspected by suitably qualified professional persons in accordance with any British Standards at intervals recommended in national guidance and will keep records of such inspections available for inspection by authorised officers upon request:
Building electrical installation
Emergency lighting system
Fire warning system
Gas boiler, calorifier or appliance
Oil fired boiler or appliance
Suspended ceilings
Portable fire fighting equipment
Temporary electrical installation
I will make sure that I have valid public liability insurance in force and that a copy of the schedule is available for inspection by an authorised officer on request.
I will not amend/alter the premises in such a way as to make it impossible to comply with an existing licence condition, without first seeking a variation of the premises licence.
I will make sure that the use of special effects or mechanical installation is arranged and stored so as to minimise any risk to the safety of the audience, performers and staff.
Any gas and electrical appliances will be tested by a suitably qualified person prior to use on the premises.
Prevention of Public Nuisance
I will make sure that doors and windows are kept closed (except for ingress and egress) to reduce noise nuisance from the premises.
I will display prominent, clear and legible notices at all exits requesting patrons to respect the needs of local residents and to leave the premises quietly.
I will ensure that during the final hour of opening the music is discernibly quieter.
I will ensure that flashing or particularly bright lights on or outside the licensed premises do not cause a nuisance to nearby properties, whilst balancing the need for lighting in the interest of prevention of crime and disorder.
I will ensure that no amplified sound in connection with the event continues beyond the permitted hours of the entertainment.
I will ensure that waste receptacles are emptied regularly to minimise nuisance smells.
I will make sure that any request by an authorised officer of the council in relation to reducing noise levels is complied with.
I will provide adequate and suitable (lidded) receptacles to store refuse, and ensure that these are maintained in a clean condition.
I will make sure that litter is regularly cleared from the vicinity of the premises.
I will not permit the playing if live or recorded music in garden areas of the premises after midnight.
Protection of children from harm
I will implement a proof of age policy agreed by the police and local authority, such as the Challenge 25 scheme. Relevant posters relating to the scheme will be displayed clearly.
We will not sell alcohol to anyone under the age of 18 or allow alcohol to be brought for a minor.
We will require proof of age upon the purchase of alcohol; we will only accept accredited proof of age cards, new photo driving licences and passports.
We will implement a strict ‘No ID - no sale’ policy and keep a refusal log of anyone refused the sale of alcohol.
I will require that children under the age of 12 be accompanied by an adult after 11pm in the evening.
